All our catering bookings are covered by contract. This is an example of our standard terms and conditions for all catering bookings. - COSTS QUOTED: Costs quoted are prepared based on the number of guests as per the contract schedule. In the case of the final number of guests falling below the number of guests contracted, we reserve the right to increase the quoted price per head. Any variation to the services that are requested by the PROMOTER, or the Number of Guests contracted, must be notified in writing to GFS at least seven (7) CLEAR working days prior to the EVENT. GFS shall use its best endeavours to comply with any requests for variations; subject always to agreeing with the PROMOTER any alteration to the costs quoted that may become necessary. For the avoidance of doubt, GFS shall not be obliged to make any such variations.
- PAYMENT SCHEDULE:
NOTE: All payments within these schedules must be cleared funds
- DEPOSIT: The EVENT requires a deposit of 30% of the total catering costs to secure. The PROMOTER will be invoiced directly for this deposit and payment must be made according to the terms of the contract.
- BALANCE: The remaining balance, plus any additional costs agreed, must be paid in full at (or prior to) the beginning of the catering service or delivery at the EVENT. The PROMOTER will be invoiced directly for the balance seven (7) CLEAR working days prior to the EVENT.
- ADDITIONAL COSTS: Any variable or additional costs incurred at the EVENT will be calculated and invoiced directly to the PROMOTER within seven (7) CLEAR working days following the EVENT.
- CANCELLATION BY THE PROMOTER: Cancellations shall be subject to cancellation fees as set out below. Cancellation fees are based on the described proportion of 100% of the quoted catering costs. Cancellation must be made immediately by telephone, and subsequently in writing, and delivered by registered post, or in person, to the GFS address at the bottom of this page.
CANCELLATION FEES: - Up to 4 weeks (28 days) prior to the EVENT; No cancellation Fee (Deposit will be refunded).
- Between 4 weeks and 1 week prior to the EVENT; The Cancellation Fee = The Deposit.
- Less than 1 week (7 days) before the EVENT; Cancellation Fee = 50% of the quoted catering costs.
- Less than 24 hours before the EVENT; Cancellation Fee = 80% of the quoted catering costs.
- CANCELLATION BY GFS: If GFS is required to cancel the booking due to circumstances beyond its control, liability shall be limited to the total amount paid to GFS by the PROMOTER.
- LIMITATION OF LIABILITY: Liability for direct losses or damages caused by GFS by negligence or failure to perform its obligations shall be limited to the total amount paid to GFS by the PROMOTER. No liability is accepted for consequential losses or damages caused by the failure of GFS to perform its obligations (whether that failure is due to negligence on the part of GFS, its officers, employees or sub-contractors or due to any other cause).
- FORCE MAJEURE: No liability is accepted for failure of performance due to strike, lock out, accidents, fire, floods, ice, obstruction, hostilities or any other circumstance outside the control of GFS.
- VALUE ADDED TAX: Prices quoted are subject to value added tax as stated.
- ACCOUNTS: All accounts must be settled according to the terms specified in the contract. Accounts not settled within such a period shall deem the booking to have been cancelled by the PROMOTER.
- INSURANCE: GFS officers, employees and sub-contractors shall hold valid Public Liability Insurance of at least five (5) million pounds.
- LAW OF THE CONTRACT: The contract which incorporates these Terms and Conditions shall be governed by English Law and the parties agree to submit to exclusive jurisdiction of the English Courts.
- COMPLAINTS: Any complaint must be made verbally within 48 hours of the EVENT concerned and should be followed with a written account of the complaint not more than 4 working days following the EVENT.
- VARIATIONS: The contents of menus, decorations, or any other item that GFS supply are subject to market availability; any alteration will be notified to the PROMOTER as soon as possible.
